HB 436 - This act creates the Missouri Airport Protection Act and requires the Missouri Highways and Transportation Commission to create an airspace review and permit process for structures that may be erected in close proximity of an airport. (Sections 305.700 to 305.702)

A permit will be required before erecting, adding to or replacing any structure within certain proximity and elevation to the airport. (Section 305.704) No permit will be issued if the FAA determines that an aeronautical study is needed. (Section 305.706)

This act exempts certain structures such as emergency repair or replace of public utility, rural electric cooperative or federally licensed radio or television structures, other than buildings to ensure continuity of proper customer service. (Sections 305.704)

This act establishes an appeal process for those permits denied. (Section 305.712) The Missouri Highways and Transportation Commission will establish rules necessary to carry out these provisions.

No money designated for highway use will be used for the enforcement of this act.
